Welcome to Netosting!
This Services Agreement (the "Agreement") contains the complete terms and conditions which govern your subscription of Web hosting, e-Commerce and other Internet-related services provided by Netosting.in, Netosting Technologies Pvt. Ltd. (the "Services"). As used in this Agreement, "Netosting.in" means Netosting.in and "Client", "you", or "your" means you. By clicking on the "Order" button, you acknowledge that you have read the Agreement, and you agree to its terms and conditions and all policies posted on the Netosting.in site. As referred to in this Agreement, "Site" refers to a World Wide Web site and "Netosting.in site" refers to the Site located at the URL http://www.netosting.in/ or any other successor Sites owned or maintained by Netosting Technologies Pvt. Ltd.
1. Account Setup and Billing
The account will be charged on the day the order is processed, regardless of the account billing date. The account will not be charged again until the next billing cycle. We will setup your account after we have received payment and we and/or our payment partner(s) have screened the order(s) in case of fraud. It is your responsibility to provide us with an email address which is not @ the domain(s) you are signing up under. If there is ever an abuse issue or we need to contact you, the primary email address on file will be used for this purpose.
2. Contact Information
You are required to provide us with accurate information when setting up your account, during the course of our relationship, and when corresponding with us. On occasion, we may need to communicate with you by e-mail about the Service. You agree to maintain a working e-mail address that is monitored daily. We have no responsibility, or liability, for interruptions in the Service, or damages of any sort, based on communications that are misdirected as a result of your failure to provide us with updated contact information.
3. Account Transfers
Our transfers team will make every effort to help you move your site to us. However, transfers are provided as a courtesy service, and we cannot make guarantees regarding the availability, possibility, or time required to complete an account transfer.
4. Backups and Data Loss
Backups are made for server restoration purposes only. No guarantees are made of any kind, either expressed or implied, as to the integrity of these backups. It is the clients' responsibility to maintain local copies of their web content and any other information. If loss of data occurs, India Internets will attempt to recover the data but does not guarantee its recovery.
5. Content
Netosting servers may be used for lawful purposes only. Transmission, storage, or distribution of any information, data or material in violation of any applicable law or regulation is prohibited. We do not permit the hosting of excessive Movies, MP3 and Torrent Files. Sites using their accounts for Backup Storage and File Download/Mirror distribution services are also not permitted. Sites breeching this policy may have their files removed without notice. Accounts that repeately ignore this warning will be suspended.
Note : Pornography and sex related merchandising are prohibited on any Netosting’s shared account. This includes sites that may imply sexual content, or link to adult content elsewhere. This is also true for sites that promote any illegal activity or content that may be damaging to Netosting Web servers or any other server on the Internet. Links to such materials are also prohibited.
6. Spam Policy
Spamming, or the sending of mass unsolicited email, from or through a Netosting server or using an email address that maintained on a Netosting server is strictly prohibited.
7. Payment Information
You agree to supply appropriate payment for the services received from Netosting, in advance of the time period during which such services are provided. You agree that until and unless you notify Netosting of your desire to cancel any or all services received, those services will be billed on a recurring basis.
Payments are accepted only in the form of crossed Cheques, Credit Cards or any other payment option communicated by company. Charges for all services are payable prior to the beginning of each service period. Failure to pay in no way relieves the customer obligations to make full payment.
Netosting retains full rights to charge for or alter specifications or discontinue any of the services/ features offered under the various schemes at any time, without any prior notice. Cheques and Drafts returned for any reason are subject to returned item charge. Service will be interrupted on accounts that reach 7 days past due.
It is the customer's responsibility to notify our sales team via email after paying for a domain renewal and to ensure the email is received and acted upon. Domain renewal notices and invoices are provided as a courtesy reminder and Netosting cannot be held responsible for failure to renew a domain or failure to notify a customer about a domain's renewal.
Netosting reserves the right to change the monthly payment amount and any other charges at anytime.
9. Taxes
Client will pay and indemnify and hold Netosting.in harmless from any and all taxes associated with or arising from Client's use of the Services, including any penalties and interest and any costs associated with the collection or withholding thereof.
10. Cancellations and Refunds
Netosting reserves the right to cancel, suspend, or otherwise restrict access to the account at any time with or without notice.
Customers may cancel at any time via a email billing@netosting.in Netosting gives you an unconditional 30 day money back guarantee on managed shared hosting for any customer who paid the first invoice with a credit card.
Cancellations requested after the initial 30 days for Shared will go into effect on the renewal date for that particular hosting package. Unless specifically requested, the account will remain active until the period expires. Any request for a refund outside of the initial 30 day period will be given on a prorated basis from when the refund was requested, if the account is eligible for a refund. Refunds are determined by the Cancellation agents at the time the account is canceled.
11. Uptime Gurantee
Our SLA agreement of 99.99% uptime is applicable only to Network availability and it does not take into account elements like emergency downtimes and Hardware failure.
12. Price Change
The amount you pay for hosting will never increase from the date of purchase. We reserve the right to change prices listed on Netosting.in, and the right to increase the amount of resources given to plans at any time.
13. Bill Disputes
If you believe there is an error on your bill you must contact us in writing. We each agree to work together in good faith to resolve any billing disputes. Your dispute must include sufficient facts for us to investigate your claims and be received by us at least 5 days prior to the Due Date (Dispute Deadline). You waive your right to dispute any charges or Fees if you fail to meet Dispute Deadline. If we find that your claim is valid, we agree to credit the account that is the subject of the dispute on your next bill.
14. Disclaimer
Netosting shall not be responsible for any damages your business may suffer. Netosting makes no warranties of any kind, expressed or implied for services we provide. Netosting disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, no deliveries, wrong delivery, and any and all service interruptions caused by Netosting and its employees.
15. Dispute Resolution
Any dispute between Netosting and a subscriber shall be determined by the laws of Republic of India. In any event of dispute the area of Jurisdiction would be in Tamilnadu only.
16. General Provisions
16.1 Notices
Notices will be sent to you at the address you provide to us. It is your obligation to ensure that we have the most current address for you in our records.

16.2. Force Majure
either party shall lose any rights hereunder or be liable to the other party for damages or losses on account of failure of performance by the defaulting party if the failure is occasioned by any occurrence or contingency beyond its reasonable control, including war, strike, fire, act of god, earthquake, flood, lockout, embargo, governmental acts or orders or restrictions, failure of suppliers, or any other reason where failure to perform is beyond the reasonable control of the nonperforming party; provided that such party shall use commercially reasonable efforts to promptly mitigate any damages or losses.
17.Change to the TOS
Netosting reserves the right to revise its policies at any time without notice.
18. Acknowledgement
By placing, hiring and continuing to maintain or place information at Netosting's servers you are stating and acknowledging that you have read the aforementioned terms and conditions and that you understand such terms and conditions and agree to be bound by them.
